Ümloud! Bands Terms of Service

The following is a set of rules and expectations for all Ümloud! band packages, including Headliner and Ultimate Band packages. All band members and captains must agree to the following in order to participate in any band package.

Definitions

The following terms will be used to describe the various rolls for the band packages.

A "Band Package" is the entity of the band. While different packages offer different perks, the package describes the collection of gifts and services related to the band package itself.

The "Band Captain" is the individual who purchased the band package. The band captain is the lead contact and is responsible for the band package. This individual decides the band members in the band and if the captain is participating in a band.

"Band Members" describe all the individuals listed as a part of the band package and the band captain.

The "Game" refers to the performance of "Rock Band 3" video game on the stage.

Notes on Band Captains

The Band Captain is solely responsible for the band. Only the band captain will decide which individuals are a part of the band package.

Requirements for Band Members

Each band member must agree to the Ümloud! Terms of Service and the Bands Terms of Service in order to participate.

All band members must be 18 years or older on the date of the event. No minors are allowed to participate in a band package.

Some elements of a band package may include items that require some or all band members to be 21 years or older on the date of the event. These items are listed in the descriptions of the package contents. Accommodations may be made to underage participants, but may not be equal in value to the original offering.

Performing at Ümloud!

Don't surprise Ümloud! staff with your actions.

Bands will communicate and work with Ümloud! on all aspects of their band performance. Ümloud! staff will accommodate for your performance, but there are limits. It is the responsibility for the band to communicate with Ümloud! staff about their performance.

There are guidelines which Ümloud!, equipment partners, and DNA Lounge require for a safe performance environment. This includes and not limited to:

• Don't break or damage the equipment.
• Don't put yourself in harm's way.
• Don't put anyone else in harm's way.
• No fire performances or pyrotechnics of any kind are allowed under any circumstances.
• No nudity. No real or simulated sex acts.

Any damage to equipment is the soul responsibility of the band members.

Talent & Likeness Release

All band members and band captains consent and authorize Ümloud! and those acting within Ümloud's authority, to, at no charge:

• Record their participation, appearance or performance on videotape, audiotape, film, photography or any other form of media.
• Use the name, likeness, voice and biographical material in connection with these recordings.
• Copy and distribute the recording in whole or in part solely by Ümloud!, and those acting under its authority, as Ümloud! deems appropriate.

Unless there is a prior outside commitment, media generated and released by Ümloud! will be released under Creative Commons Attribution-NonCommercial-ShareAlike 3.0 . This means that with some exceptions (such as music), you will be able to use the media of our likeness just as we use it.

Conduct of Participants

Band members must adhear to all instructions and requirements of Ümloud! and DNA Lounge staff during the event.

Access to the venue, stage and other aspects are at the discretion of Ümloud! staff and DNA Lounge whom reserve the right to deny access to the venue and/or stage to any individual who demonstrates a risk to the safety of all participants, guests, and event staff. For example, an individual who is inebriated may not be allowed into the venue or on stage, even if they are a part of a band package to Ümloud!.

Waiver and Release of Liability

By accepting an invitation into or purchasing a band package, you agree to the following statement:

"I, the participant, wish to play the “Rock Band” game at the Ümloud! Rock Band Night Charity event being held on Thursday, December 6, 2012 and understand that playing Rock Band (hereinafter called the “Game”) involves certain risks. Those risks include, but are not limited to, the risk of injury resulting from possible malfunction of the equipment used in the game and from injuries from tripping or falling over obstacles in the stage areas. In addition, I recognize that overexertion of playing the game could result in injury or death.

Despite these and other risks, and fully understanding such risks, I wish to play the Game and hereby assume the risks of playing the Game. I also hereby hold harmless Ümloud! and DNA Lounge and indemnify them against any or all claims, actions, suits, procedures, costs, expenses (including attorney's fees and expenses), damages and liabilities arising out of, connected with, or resulting from my playing the Game, including without limitation, those resulting from the manufacture, selection, delivery, possession, use or operation of such equipment. I hereby release the Sponsors from any and all such liability, and I understand that this release shall be binding upon my estate, my heirs, my representative and assigns. I (and the parent(s) or legal guardian(s) of the participant, if applicable) also hereby certify to Ümloud! and DNA Lounge that I am in good health and do not suffer from a heart condition or other ailment which could be exacerbated by the exertion involved in playing the Game."

Changes

Ümloud! reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes.
